Terms of service for the «One Click» application

This is a translation. The Mongolian version of these terms is the text that governs.

These terms of service are a legal document, with legal effect, granting «Tovkhon Inguumel NBFI» LLC the right to receive and store certain information about you in the «One Click» loan application, to use it for the purposes set out in these loan terms, and to process the information you submit.

We therefore recommend that you read these terms of service carefully and decide whether to accept them. If you enter the four-digit confirmation code sent to the mobile number you registered with the «One Click» loan application into the «CONFIRMATION CODE» field and press «CONFIRM», you are deemed to have accepted these terms of service and to have signed them.

You can use our application by downloading «One Click» from the Google Play Store or the App Store and registering and confirming your information. Registration information includes:

Mobile phone number
Surname and given name
National registration number
Email address
Facebook name and ID

1. By accepting these terms of service you grant «Tovkhon Inguumel NBFI» LLC the following permissions and rights.

To receive and store the personal and financial information you create and transmit.
To analyse the personal and financial information you create and transmit with the help of artificial intelligence, and to check and confirm that it is accurate.
To use the personal and financial information you create and transmit to determine the loan amount and terms available to you and, where a decision is made to lend to you, to prepare the draft loan agreement to be concluded with you.
Information collected under the procedure set out in these terms of service will be used for internal purposes connected with improving the quality and reach of the service provided by «Tovkhon Inguumel NBFI» LLC's «One Click» loan application and with releasing new products. It will also be used to develop the «One Click» loan application and its artificial intelligence.

2. When you enter your personal and financial information into «TOVKHON INGUUMEL NBFI» LLC's «One Click» loan application, you undertake the following obligations:

Not to enter false information.
Not to enter another person's personal or financial information.
If you breach these Terms of service and enter false information, «Tovkhon Inguumel NBFI» LLC has the right to review your loan request and refuse to conclude a loan agreement.
If you breach these Terms of service and use or transmit another person's name or personal or financial information, «TOVKHON INGUUMEL NBFI» LLC has the right to review your loan request and refuse to conclude a loan agreement. You bear full responsibility for any harm or loss your unlawful act causes to the owner or holder of that information and to «TOVKHON INGUUMEL NBFI» LLC.

3. Rights and obligations of «TOVKHON INGUUMEL NBFI» LLC's «ONE CLICK» loan application.

To obtain changes to a customer's personal information from the competent registration authority of Mongolia in accordance with the General Law on Registration of Mongolia;
To require a customer to perform the obligations assumed under legislation and under the agreement, and to terminate the agreement where those requirements are not met;

«TOVKHON INGUUMEL NBFI» LLC will suspend borrowing rights without prior notice and, where necessary, terminate the agreement in the following cases. Namely, where the customer:

Has repeatedly breached the obligations assumed under the agreement;
Has used the loan for unlawful activity;
Has given false information;
Has acted fraudulently;
Has obstructed the operations of «TOVKHON INGUUMEL NBFI» LLC;
Has used the «ONE CLICK» loan service in a way that is harmful or improper to other customers;
Has lost legal capacity;

To close a customer's borrowing rights on the basis of a notice received from a law enforcement or supervisory authority and, where necessary, to suspend or cancel those borrowing rights;

4. Confidentiality of customer information.

«TOVKHON INGUUMEL NBFI» LLC is obliged not to use the personal and financial information you enter for any purpose other than those set out in these terms of service, and not to disclose it to others. It also undertakes to protect the confidentiality of that information.
The application software automatically archives the customer's core information and information about loans and repayments on a server, and paper documents are kept in an archive.
The application software and system fully meet the technical conditions required to protect the confidentiality of customer information. This covers not only the customer's personal information but all information related to the service received from the NBFI.
Using information collected with the customer's consent otherwise than as set out in the Terms of service, or disclosing it to an unrelated third party, is prohibited, and the obligation to protect its confidentiality is assumed.
When downloading, registering for and using the Application, the customer is reminded to maintain the confidentiality of their own information, and this is set out in the agreement concluded with the customer as follows.

1. Not to pass the login name, password or transaction security code for accessing the Application to a third party;
2. Where the customer changes their transaction security settings, to bear sole responsibility for any issue, consequence or loss arising from that change and attributable to them;
3. To immediately change the login password and transaction security code and notify «TOVKHON INGUUMEL NBFI» LLC on learning that the login password or transaction security code has been lost or stolen, that an unauthorised transfer has been made to their loan account, on discovering any error, breach or deficiency in the records relating to their borrowing rights, or on suspecting that an unauthorised third party may have learned their security code or other codes;
4. The holder of the electronic borrowing rights bears full responsibility for loss arising from failure to perform an obligation set out in the agreement, or from performing it late;
5. To keep confidential the login name, password and other information used in the Application, and to bear full responsibility where that information is lost through the customer's own fault;

5. Information confirmed by the fingerprint of a customer who has received or is receiving the service cannot be deleted or changed.

6. Accepting these terms of service, you will complete your financial information in the «ONE CLICK» loan application truthfully and accurately. You will further complete and confirm your personal and collateral information truthfully and accurately. If you complete your financial information in the «ONE CLICK» loan application falsely, this may be grounds for «TOVKHON INGUUMEL NBFI» LLC to refuse to conclude an agreement. Please note that in that case «TOVKHON INGUUMEL NBFI» LLC will not be responsible for your loss.

Your acceptance of these terms of service and your use of the «ONE CLICK» loan application is not grounds for treating a loan agreement as having been concluded between you and «TOVKHON INGUUMEL NBFI» LLC, or for treating «TOVKHON INGUUMEL NBFI» LLC as having promised to lend to you, as having made an offer to conclude an agreement, or as having accepted such an offer. Furthermore, these terms of service do not give you the right to make any claim against «TOVKHON INGUUMEL NBFI» LLC on any matter other than those specifically mentioned in them.

If you enter the four-digit confirmation code sent to the mobile number you registered with the «ONE CLICK» loan application into the «CONFIRMATION CODE» field and press «CONFIRM», you are deemed to have accepted these terms of service and to have signed them.

If you do not accept these terms of service, please press «X». Please note that in that case you will not be able to use «TOVKHON INGUUMEL NBFI» LLC's «ONE CLICK» loan application. We therefore ask you to read these terms of service carefully and decide whether to accept them.
